What to check before you ship it in India
- TCCCPR 2018 defines commercial communication by its primary purpose of soliciting business, a transactional message by the recipient being the sender's customer, and a service message by the recipient being CURRENTLY in an employment relationship. A candidate is none of those, so the regulation does not plainly reach candidate messaging — but operators enforce DLT registration and template rules on A2P traffic regardless, so treat it as an operational constraint rather than a settled legal one: the sender registers a header and registers the content template in advance, and only the template's variable fields may change. Wording composed freshly for each candidate does not fit a pre-registered template.
- Slots, panel identities and contact details are personal data. The employment legitimate use in s.7(i) of the DPDP Act is written around a Data Principal who is an employee, so whether it reaches a candidate who has not been hired is not settled on the text — do not assume it does.
- UK government guidance flags recruiting chatbots specifically: a general-purpose chatbot placed in front of applicants may give answers that are wrong or unlawful because it was never trained on the employer's own process.
