What to check before you ship it in India

  • The DPDP Act defines a child as an individual who has not completed eighteen years, so in school settings almost every learner is one. Pasting a pupil's own script into a drafting tool to mine it for question ideas processes that child's personal data.
  • Where a child's personal data is processed, s.9(1) requires verifiable consent of a parent or lawful guardian first. A teacher's convenience is not a consent, and the school cannot supply one on the parent's behalf simply because the pupil is enrolled.
  • Published evaluations report significant variance between models generating items at a given cognitive level, and that automated quality scoring of generated questions does not match human judgement — so the teacher's review is the control, not a formality.
